Terms of Service & Legal

By using A+ Assignments ("the Service," "we," "us," "our"), you ("the Client," "you," "your") agree to the following terms. If you do not agree, do not use the Service.

1. Nature of Service

A+ Assignments provides custom-written academic sample papers for educational reference and study purposes only.

All documents produced by the Service are intended to be used as:

  • Study guides and reference materials
  • Examples of proper academic formatting, citation, and structure
  • Research aids to help the Client understand a topic
  • Templates demonstrating how an academic paper on a given subject should be organized

We do NOT encourage, condone, or facilitate the submission of our sample papers as the Client's own original work. The Client assumes sole responsibility for how they use the delivered materials. A+ Assignments bears no liability for any academic, legal, or disciplinary consequences arising from misuse of the delivered documents.

Legal Basis

The production and sale of academic sample papers is not prohibited under any federal or provincial law in Canada. There is no Canadian legislation, statute, or regulation that criminalizes the operation of academic writing services.

Precedent: R. v. Farsad (1989, Ontario)

In the only known Canadian criminal prosecution of an essay mill operator, the owner of an Ontario-based essay writing service and his spouse were charged under Criminal Code fraud provisions. The case was dismissed by the judge. This remains the only attempted prosecution of a contract cheating provider in Canadian history, and it failed. The contract cheating industry has operated legally in Canada ever since.

Legislative History: Canada Has No Essay Mill Law

Unlike England (Skills and Post-16 Education Act 2022), Ireland (Qualifications and Quality Assurance Act 2012, s.43A), Australia (Tertiary Education Quality and Standards Agency Amendment Act 2020), and 17 US states, Canada has never enacted legislation making the operation of essay mills or contract cheating services illegal. Legislative proposals dating back over 50 years have consistently failed to materialize.

2. Intellectual Property & Ownership Transfer

Upon full payment, all intellectual property rights to the delivered document transfer entirely and irrevocably to the Client. The Client becomes the sole proprietary owner of the work product.

  • A+ Assignments retains no rights, copies, or claims to the delivered work after transfer
  • The Client may use, modify, distribute, or dispose of the document at their sole discretion
  • The document is a "work made for hire" under the principles of the Canadian Copyright Act (R.S.C., 1985, c. C-42)
  • A+ Assignments waives any moral rights associated with the work product

Once you pay, it's yours. Fully. Completely. Irrevocably. We have no claim to it. What you do with your own property is your own business.

3. Refund Policy (Turnitin Guarantee)

A+ Assignments offers a conditional money-back guarantee on Turnitin originality results, subject to the following terms:

3.1 Eligibility for Refund

A full refund will be issued if all of the following conditions are met:

  1. The delivered sample paper receives a Turnitin AI detection score of 20% or higher
  2. The Client provides a verifiable, unaltered Turnitin AI detection report as evidence within 14 days of delivery
  3. The document has not been modified, edited, or altered by the Client or any third party prior to the Turnitin scan
  4. The Turnitin report is from an institutional account (not a free/trial checker)

3.2 What This Guarantee Covers

This guarantee covers Turnitin AI detection only. It does not cover similarity/plagiarism scores. Similarity scores can be inflated by assignment templates, required headings, rubric language, common phrases, properly cited quotations, and reference lists, none of which indicate any issue with the delivered work.

3.3 Exclusions

The refund guarantee does not apply if:

  • The Client altered the document before running it through Turnitin
  • The claim is based on similarity/plagiarism score (not AI detection score)
  • The Turnitin report cannot be verified or has been tampered with
  • The refund request is submitted more than 14 days after delivery
  • The Client failed to provide sufficient source materials or instructions as requested
  • The AI detection flag is caused by Client modifications made after delivery

3.4 Refund Process

To request a refund, email [email protected] with the subject line "Refund Request" and attach the Turnitin report. Refunds are processed within 7 business days via the original payment method.

3.5 Revision Before Refund

Before a refund is processed, A+ Assignments reserves the right to offer one (1) free revision to address the similarity issue. If the Client declines the revision, the refund will proceed subject to the above conditions.

4. Disclaimer of Liability

4.1 Academic Consequences

A+ Assignments is not liable for any academic penalties, disciplinary actions, suspensions, expulsions, or grade reductions that may result from the Client's use of the delivered documents. The Service explicitly states that all documents are sample papers for reference purposes only.

4.2 No Guarantee of Grades

A+ Assignments does not guarantee any specific grade, mark, or academic outcome. The quality of the sample paper is based on the materials and instructions provided by the Client. Academic results depend on factors outside our control, including but not limited to: professor discretion, institutional rubric interpretation, and the Client's own modifications to the document.

4.3 Assumption of Risk

The Client acknowledges and accepts that:

  • Academic institutions may have policies regarding the use of third-party academic assistance
  • The Client is solely responsible for understanding and complying with their institution's academic integrity policies
  • A+ Assignments has no obligation to investigate or advise the Client on their institution's specific policies
  • Any decision to submit, reference, or use the document in any manner is the Client's sole decision and responsibility

5. Defense Against Claims

For anyone considering legal action against A+ Assignments, we respectfully invite you to review the following legal realities:

5.1 No Criminal Offence Exists

There is no provision in the Criminal Code of Canada (R.S.C., 1985, c. C-46) that criminalizes the production or sale of academic sample papers. Section 380 (fraud) requires proof of "deceit, falsehood or other fraudulent means" that "defrauds" someone of "property, money or valuable security." We deliver exactly what is ordered and paid for. There is no deprivation and no deceit.

Why Fraud Charges Won't Stick

Section 380 of the Criminal Code requires the Crown to prove: (1) deceit or falsehood, (2) that caused deprivation of property, money, or service. A+ Assignments delivers the exact product ordered by the Client at the agreed price. The Client receives a completed document. There is no deprivation. The only Canadian attempt to prosecute an essay mill under fraud provisions (R. v. Farsad, 1989, Ontario) was dismissed.

5.2 No Civil Cause of Action

A civil lawsuit requires demonstrable damages. Potential claimants should note:

  • Educational institutions have no contractual relationship with A+ Assignments. There is no privity of contract. Any academic integrity issue is between the institution and its student under their internal policies, not a matter for civil litigation against a third-party service provider.
  • Students receive the product they paid for. The terms are clear, the product is delivered, and a refund policy exists. There is no breach of contract, misrepresentation, or negligence.
  • Third parties have no standing. A+ Assignments owes no duty of care to institutions, professors, or other students.
Precedent: UK Essay Mill Litigation (Pre-2022)

Prior to the Skills and Post-16 Education Act 2022, UK universities attempted various legal strategies against essay mills operating legally. All failed. The Quality Assurance Agency for Higher Education (QAA) specifically noted in its 2019 report "Essay Mills and the Case for Legislation" that existing fraud and consumer protection laws were inadequate to prosecute essay mills because of their disclaimers and terms of service. This led to the need for specific legislation, which Canada has not enacted.

5.3 Competition Act Compliance

A+ Assignments complies with the Competition Act (R.S.C., 1985, c. C-34):

  • Section 52 (False Representations): All claims on our website are truthful. Pricing is transparent. The nature of the product (sample paper for reference) is clearly stated. No material misrepresentation is made.
  • Section 74.01(1)(c) (Warranties): Our Turnitin guarantee has clear, published terms and conditions (see Section 3 above). We honor all refund requests that meet the stated criteria.
  • Section 74.02 (Testimonials): Client feedback displayed on our website reflects genuine service experiences. Individual results may vary based on materials provided.

5.4 Jurisdictional Notice

A+ Assignments operates under the laws of Canada. Any dispute arising from these terms shall be governed exclusively by the laws of the Province of Alberta and the federal laws of Canada applicable therein. The Client consents to the exclusive jurisdiction of the courts of Alberta.

In plain English: We sell sample papers for reference. This is legal in Canada. We deliver what we promise. Our terms are clear. Our refund policy is real. The only Canadian prosecution of an essay mill was dismissed in 1989. No law prohibits what we do. If you're thinking about a lawsuit, respectfully, fly off. ✈️

6. Client Responsibilities

By placing an order, the Client acknowledges and agrees that:

  1. The delivered document is a sample/reference paper and is not intended for direct submission as the Client's own work
  2. The Client is responsible for complying with their institution's academic integrity policies
  3. The Client will provide accurate and complete instructions and materials to facilitate the best possible sample paper
  4. The Client will not hold A+ Assignments liable for academic consequences arising from misuse of the delivered materials
  5. The Client will not issue fraudulent chargebacks for services that were delivered as described

7. Revision Policy

Each order includes one (1) complimentary revision, subject to the following:

  • The revision request must be submitted within 7 days of delivery
  • The revision must not change the fundamental scope, topic, or requirements of the original order
  • Additional revisions beyond the first may be subject to additional charges
  • Revision requests should be sent to [email protected] with the original order details

8. Privacy & Confidentiality

A+ Assignments takes Client privacy seriously:

  • We do not share Client information with any third party, including educational institutions
  • Client files and materials are used solely for completing the ordered sample paper
  • We do not retain copies of delivered work after 30 days
  • All communications are confidential
  • We will never contact a Client's institution, professor, or any academic authority

9. Modifications to Terms

A+ Assignments reserves the right to modify these terms at any time. Changes take effect upon posting to this page. The "Last updated" date at the top reflects the most recent revision. Continued use of the Service after modifications constitutes acceptance of the updated terms.
